Webinar, from the Seminar on 23 April 2024

An overview of the Environment Protection Stronger Regulation and Penalties Act 2024
and the Environmental Legislation Hazardous Chemicals Act 2024
Discusses compliance issues, impacts and advice on how to best manage them

Largest changes in 20 yrs are now in force, with the doubling of penalties is just the tip of the iceberg. All will require the attention of
environmental managers and environmental professionals, such as; increased care against corporate self-incrimination, very
careful assessment of; wastes, recycled materials, soils and fill, to management changes for these new liabilities. This Seminar
/ Webinar will look at discussing how to comply and more with these key changes:

  • Implications of the increased environmental penalties and their impact of new liabilities on your site
  • Impact of the removal of the use of Voluntary Environmental Audits (VEA) for protecting documents
  • New Recall Notices (RN) which can recall products and wastes and Preliminary Investigation Orders (PN)
  • Changes and impacts on Resource Recovery Orders and Exemptions (RROE) and recycled products
  • Incorporation the EHC Act under the POEO Act and the new NSW IChEMS registry
  • How these new environmental liabilities will impact and change your environmental management focus

The Environment Protection Legislation Amendment (Stronger Regulation and Penalties) Act 2024 (NSW) was introduced
as a response to the asbestos contaminated mulch investigations by the EPA, but include many amendments across 7 EPA
managed Acts and 2 Regulations.  These will impact on NSW business including:

  • New Public Warning Statements on persons, companies which are a risk the environment and health
  • New illegal waste dumping laws; $4 million for asbestos related
  • Introduction of the Waste Classifier Accreditation Scheme who can officially classify wastes in NSW

The Environmental Legislation Amendment (Hazardous Chemicals) Act 2024 includes compliance with the NSW IChEMS
Registry, which is based on the Commonwealth’s IChEMS, with the ability for NSW to include additional substances. For
example, additional PFASs may be added to Schedule 7 and controlled under these changes in the future. RN could include
products with certain IChEMS substances or specific waste products, e.g. containing asbestos under RROEs. Asbestos is a
ubiquitous contaminant, which can be missed by routine QC. Making and receiving recycled materials has become more
difficult with new systems required to minimised these increased legal risks.
