POEO (Clean Air) Regulation 2022 - Major Tightening of Your Air Emissions


This webinar will overview the new POEO (Clean Air) Regulation 2022 (CAR) significantly tightens of air contaminant emissions from existing stacks and other sources. CAR will sunset the Group 3 & 4 limits (air pollution equipment & some processes build before December 1997) to move to Group 5 then Group 6 limits. For example,

  • If your boilers were installed before August 1997, you may need to replace them
  • Air pollution equipment of this age will likely need to be upgraded
  • Fuel burning equipment may require major modifications
  • Emissions under Group 4 would need to improve from ~250 mg/m3 Suspended Particulates, (SP) to 50 mg/m3 SP, under
    Group 6

The only way to avoid upgrading to new air pollution equipment is apply to the EPA for a Legacy Condition, but you only have a little over 2.5 years to apply.  There are many other changes to tanks, motor vehicles etc.

ASBG and many others showed the cost benefit in the supporting Regulatory Impact Statement was flawed, grossly underestimating the costs to industry.  It has been removed from the EPA website.  ASBG is running this webinar to inform NSW Environment Licence Holders (EPL) what are the consequences of the new CAR and how this interleaves with the EPA's Climate Change Mitigation and Adaptation Plans which are also
being developed.

All Environmental Managers, etc, will need to quickly assess the impact of the CAR 2022, especially assessing if their sites require: new boilers, particulate air filters or other new equipment or processes etc.  Cost of such replacements will need to be assessed with the cost of application of legacy controls, assuming these will be successful with the EPA.
